These terms are an agreement between you and the company named under "Who is responsible" at the top of this page ("we", "us"). They apply when you use the FAM360 apps for iPhone and Android and the website fam360.app. How we handle personal data is explained in the privacy policy at fam360.app/legal/privacy-policy. By creating an account, you accept these terms.
1. The service
- FAM360 lets adults share their location with the members of their family and with other people they choose, exactly or as an approximate area, and pause or stop sharing at any time.
- A parent or guardian can add a child profile and connect the child's phone with a single-use code. The child's phone always shows that it is connected, to which family, and who can see its location.
- FAM360 shows whether a family phone is connected, low on battery or missing a permission, and sends the notifications you choose.
- FAM360 is free: there is no subscription, no in-app purchase and no advertising.
- We switch some features on and off for everybody at once. A feature that is switched off does not appear in the apps.
2. Who may use FAM360
- You must be at least 18 years old to create an account.
- Children do not have accounts. A child uses FAM360 only on a phone that their parent or guardian connected.
- The information you give when you sign up must be yours and correct. Keep your password to yourself. If you think somebody else used your account, change your password and write to us.
3. Sharing locations, and the people you add
- Every adult decides whether to share their own location, with whom and how precisely, from their own account. Nobody can switch it on for another adult.
- Connect only the phone of a child for whom you are a parent or legal guardian, or for whom you act with the authority of one. Add a child profile only for such a child.
- Invite only people you know, to an address they use. Joining never switches sharing on: the person decides.
- Never use FAM360 to follow another adult secretly or without their agreement. FAM360 is not a tool to watch a partner, an employee or anyone else behind their back.
- The child's phone shows what is shared and with whom. Explain it to the child in words they understand.
- You are responsible for the names you enter, such as a family name, a group name or a child's first name.
4. What you must not do
- Use FAM360 to monitor, stalk, harass or harm anybody.
- Try to reach an account, a family or a phone that is not yours, or get around the app's permissions.
- Disrupt or overload the service, probe it for weaknesses without our agreement, or copy it by automated means.
- Use FAM360 in breach of the law or of other people's rights.
5. FAM360 is not an emergency service
- A position on the map can be old, approximate or missing: a phone can be switched off, have no network or no battery, or not be allowed to give its location. Every position shows how old it is.
- Notifications can arrive late or not at all: they depend on Apple, Google, the network and the phone's settings.
- FAM360 does not contact emergency services and does not replace them. In an emergency, call your local emergency number.
6. Availability and changes to the service
- We work to keep FAM360 available and correct, but we cannot promise that it will always be available or free of errors. Maintenance, network problems or the services of Apple, Google or our other providers can interrupt it.
- We may change, add or remove features. We describe what is collected for each feature in the privacy policy.
- The map is provided by MapTiler and the phone's position by its own location services, each under its own terms.
7. Your account and its end
- You can delete your account at any time in the app (Settings, Account, Delete my account) or at fam360.app/account-deletion.
- A deletion is final. Your location data and your sessions are erased at once, and the rest of your data 30 days later, except the security log of account actions, kept 400 days, as the privacy policy explains.
- We may suspend or close an account that seriously breaks these terms, is used for fraud, abuse or an unlawful purpose, threatens the security of FAM360, or puts another person at risk.
- Unless it would be unsafe or unlawful, we first tell the account holder by e-mail what the problem is and, where the situation allows it, give them a reasonable opportunity to put it right. When security, the law or the protection of another person requires it, we may act at once and explain our reasons afterwards.
- You can contest a suspension or a closure by writing to us.
8. Our liability
Nothing in these terms excludes or limits our liability where the law does not allow it, or takes away the rights that consumer law gives you.
FAM360 depends on information that is not always available or exact (section 5). We are therefore not responsible for the consequences of a position that is late, approximate, missing or wrong, or of a notification that arrives late or not at all, when this comes from the network, a phone's settings, battery or location services, the services of Apple, Google or our other providers, or anything else outside our control. We are not responsible either for how the people with whom you choose to share your location use it.
9. Changes to these terms
We may change these terms. We tell account holders about a significant change by e-mail at least 30 days before it takes effect, unless a shorter period is required for legal or security reasons. The effective date at the top of this page says from when this version applies. If you do not accept a new version, you can delete your account before it takes effect.
10. Law and disputes
- These terms are governed by French law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of the law of your country of residence.
- If you have a complaint, you can write to us first (section 11) so that we can look for a solution together.
- A dispute is brought before the courts that have jurisdiction under the applicable mandatory rules. As a consumer, you can bring it before the courts of the place where you live, where those rules allow it.
